General
Principles
According to Article 36 of the Constitution of the Kingdom of Cambodia stated
that all the Cambodian people have right to establish union and become its
members. On 10 December 1996 there were hundreds of
workers as a whole of the countries who worke for various factories have signed
on a resolution
nominating and recognizing three workers as their representative to negotiate
with the managements
where they work for in goal to protect their right and their interest. This
is first step to invent a democracy
trade union in the Kingdom of Cambodia called Free Trade Union of Khmer Workers.
In February 02, 1997
Free Trade Union of Khmer Workers was held an extra-ordinary congress in Phnom
Penh and had announced to rename as Free Trade Union of Workers of the Kingdom
of Cambodia and have adopted some changes
of this constitution.
In March 07, 1999, Free Trade Union of Workers of the
Kingdom of Cambodia was held a second national congress to elect its president
for the second mandate and had adopted and changed some
points of its constitution.In May 20, 2001, Free Trade Union of Workers was
held a third national congress in
Phnom Penh to elect a president for third mandate and it was adopted and changed
some articles in this constitution.
In March 01, 2003 Free Trade Union of Workers of the Kingdom of Cambodia was
hold a fourth national
congress in Phnom Penh to elect a president for its fourth mandate and it was
adopted and changed some points
in this constitution, which was written in this constitution.In June 27, 2004
Free Trade Union of Workers of the
Kingdom of Cambodia was hold an extra ordinary national congress to elect a
new president to continue for fourth
mandate instead of the ex-president whom was killed by the unknown killers.
From
FTUWKC was born until nowadays,
our union has been conducted strikes and demonstrations at various factories
in the city as well as in the provinces
to demand for labor law practice, respecting the workers' right and demand
for changing of working condition and
worker's wages. The struggles of Cambodian workers in the leading of our union
were learn publicly not only in the
Kingdom of Cambodia but also in the globe. As the witness of our struggle,
our union was publicized by the national
and international media. about our brave and struggle to conduct strikes and
demonstration have been happened in
the history of Cambodia.The Free Trade Union of Workers of the Kingdom of Cambodia
is the largest garment textile
trade union in Cambodia formed by the workers and staff members on a voluntary
basis. FTUWKC takes the labor law
of the Kingdom of Cambodia as the fundamental criteria for their activities,
conduct their work in an independent way
in accordance with the constitution of the FTUWKC, and exercise their rights
and fulfill their obligations according to the
labor law of the Kingdom of Cambodia.
The major social function of the FTUWKC
is to protect the legitimate interests,
democratic rights of workers and staff members; to mobilize and organize workers
and staff members to take an active
part in the construction and reform, accomplish the tasks of economic and social
development; to represent and
organize workers and staff members to take part in the administration of the
state and social affairs and in
the democratic management of enterprises, undertakings and state organs; to
educate workers and staff
members to constantly improve their ideological and ethnical qualities and
their scientific and cultural qualities
in a bid to build up a well-educated and self-disciplined contingent of workers
and staff members with lofty ideals
and moral integrity.
Chapter I Goal
Article 1.
According to Article 36 of the Constitution of the Kingdom
of Cambodia, hundreds of workers have been united to establish
a union called "Free Trade Union of Workers
of the Kingdom of Cambodia" and its acronymis FTUWKC.Free
Trade Union of Workers of the Kingdom of Cambodia's motto
is "Social Justice is the Foundation
of Peace"
Article 2.
Free Trade Union of Workers of the
Kingdom of Cambodia has goals as stated below:
1. Encouraging unity's widespread between all the workers in Cambodia irrespective
of their nationality, race, sex,
occupation, religious belief, educational level and political trend.
2. Role-play as the workers representative in order to protect right and all
the interest of workers.
3. Foster the workers living in demanding the wage's increasing and various
supports from the investors, management,
enterprise and companies.
4. Demand for proper time of working hours and various working conditions to
coordinate their lives, protect the dignity
and health insurance, safety and security for workers.
5. Demand and follow up the practice of law especially the labor law at working
place and other place as well.
6. Push the practice of democracy in the factories, enterprises and companies
as well.
7. Improve the capacities of working and general knowledge of workers via occupational
education program and other
vocational trainings.
8. Foster the solidarity between workers in Cambodia as well as workers in
other countries in the world.
9. Initiate and organize all the lawful action that help the right's protection
and serve for workers' benefit.

II Structure
Article 3.
Trade union structure was organized as:
1. Union congress
2. Steering committee
3. Executive office
4. Union Advisor
Part
1: National Congress
Article 4.
Congress is the supreme institution of union. Congress is leaded and organized
by the union members Congress indicates the union's steps and directions
and adopts any special decisions, which the steering committee submitted.
Congress is hold to elect the union president and depend on most of present
steering committees. The election was stated in the internal regulation
of union. Congress can reform the union's structure.
Article 5.
Union congress was divided into two are Congress and extra-ordinary congress.
1. National Congress is held in every three year. The time schedule for
the congress will be timed by the steering committee.
2. Extra-Ordinary Congress held depending on the decision of the President
or most voices(2/3) from the steering committee or voice of 50%+1 of a
whole union members. All cases there is steering committee summon for meeting
and organizing either national congress or extra-ordinary congress. National
congress has to be held on the present of the union's president.

2: Steering Committees
Article 6.
There are 11 members of board committees who elected by raise their hands
during the congress by suggesting from the union president.
Article 7.
Steering committees control the practice and union's policies which defined
by the congress. Steering committee can initiate in leading the union and
establish the skills committee to assist the executive office. All the
steering committee has to pay monthly for the union's membership of 2000
Riel each.
Article 8.
Steering committee leaded by a president. Steering committee select a vice
president and General Secretary according to the union president's suggestion.
Article 9.
Steering committee reunion, at least once per month. In special case, president
or 1/3 voices of steering committee member have a privilege to call for
a meeting for steering committee. Steering committees establish a discipline
committee to solve the internal dispute (as stated in Part 7 Chapter 2)

3: Executive Office
Article 10.
Executive Office is the executive institution of the union. Executive invented
by the qualification of the steering committee ranging from 9 to 15 of
steering committee to lead the organization and perform the daily duty
of the union.
Article 11.
Executive Office implement the target and goal of the union that defined
by the congress and under control of
the steering committee who have full right to decide all problems and necessary
tasks except nominating and strip off position of steering committee or
correction of the union's structure. All the above decisions executive
office have to take responsible facing the steering committee.
Article 12.
Executive Office organize various major projects and submit to steering
committee to check and verify in advanced before adopted by the plenary
congress.

Executive Office included:
President 1 person
Vice president 1 person
General Secretary 1 person
Deputy General Secretary 1 or 2 persons
Treasurer 1 person
Deputy Treasure 1 person
Accountant 1 person

4: About President
Article 14.
Union president selected by the congress via secret election and most voices
of presence membership for third
mandate. For participants who has already been elected as the president
for 2 mandates will not be have right to
re-represent for the next mandate.
Article 15.
Union might have honorary president whom nominated by the steering committee
via union president's suggestion. However, ex-president will become as
the the Union Honorary President if there is agreement from his or herself
and steering committee.
Article 16.
Union president has the privilege to nominate vice president, General Secretary,
Deputy General Secretary, Treasurer, Deputy Treasurer, Accountant and Advisor
included others steering committees whom are agreed by the plenary
congress.
Article 17.
Vice president is provided tasks by the president. When there is unavailable
president and then vice president is nominated as the Acting President.
Article 18.
In a case of the president resigns or he/she has no ability to head the
union, steering committee have to select the new president among the steering
committee member.

5: Secretariat and Treasurer
Article 19.
Secretariat managed by one secretary and followed by two deputy secretaries.
Secretary responsible for the big section daily tasks of the union.
Article 20.
Treasurer responsible for union's budget and financial system. Treasurer
included a deputy treasurer and an accountant . |
